How to select the right contract type?
We serve templates for the following list of types of contracts. Please read this carefully as to select the right one for your situation.
Funding agreement
- It is used to sub-contract certain project activities to an implementing partner. It defines the terms and conditions for providing the funding to a recipient, outlining the responsibilities, expectations, and obligations of both the funder and the recipient.
Semi-restricted is applicable when Cordaid's own funds are used to financing the project. That means that there is no back donor. Please note that we treat SHO, Nationale Postcode Loterij (NPL) as semi-restricted funds.
Restricted means that Cordaid receives the project funding from a donor based on a grant agreement. Consequently, Cordaid sub-grants project activities in part or full to the implementing partners. Implementing partners are often included in the project proposal.
Partnership (consortium) contract
- Legally formalizes the relationship between multiple parties collaborating on a project, by defining their roles, responsibilities, contributions, etc. It serves as a project management tool to establish clarity, manage expectations, prevent disputes, and ensure that all partners have a clear understanding of the terms and conditions governing their collaboration.
Procurement contract
- Procurement contract is needed, when Cordaid contracts a supplier for providing goods, services, or works based on a commercial contract. Supplier is selected through procurement procedures (tenders, direct award, framework agreements). The difference between consultancy, service and purchase lies in the nature of an assignment. A consultant/consultancy company provides expert advice, strategy, and solutions to solve a client's problems, while a purchase is the act of acquiring a physical product or a tangible service, such as buying a car or software. Lastly, service provides execute a specific task focusing more on the actual delivery of services.
Pre-bid agreement
This template is used for the opportunities that are still in pipeline. If Cordaid intends to work in a Consortium with the Co-Applicant(s) to submit a proposal and, if awarded, implement a project, Cordaid should sign a pre-bid agreement with the Co-Applicants. Pre-bid agreement can be entered between two or more parties.
Memorandum of Understanding
- Establishes a general framework between two or more parties, clearly outlining their shared goals, intentions, roles, and responsibilities for a specific collaboration. Since MoU outlines general framework, it is often followed by a specific agreement.
DRA (Humanitarian Aid)
- This is a specific agreement, which is only applicable for Humanitarian Aid projects funded by DRA.
